These Terms of Use ("Terms") govern your access to and use of the Website and any related pages, content, forms, communications, and services provided by Atlas Gold Group ("Atlas," "we," "us," or "our"). By accessing or using the Site, you represent and warrant that you are at least eighteen (18) years of age and that you have read, understood, and agree to be bound by these Terms.

1. No Investment, Legal, or Tax Advice; Not a Financial Institution; Not a Custodian

Nothing on the Site constitutes or should be construed as investment advice, legal advice, tax advice, or any other professional advice. Atlas is not a bank, insured depository institution, broker-dealer, registered investment adviser, or IRA custodian. Atlas does not provide fiduciary services and does not act as a trustee or custodian of retirement assets.

2. Content; Intellectual Property; Limited License

All text, graphics, logos, images, audio, video, design elements, compilations, software, and other materials on the Site (collectively, "Content") are owned by Atlas or its licensors and are protected by intellectual property laws. Atlas grants you a limited, revocable, non-exclusive, non-transferable license to access and use the Site for your personal, non-commercial evaluation of Atlas products and services.

You may not copy, reproduce, distribute, publicly display, publish, transmit, sell, license, create derivative works from, reverse engineer, decompile, disassemble, or otherwise exploit any Content without Atlas's prior written consent.

3. Prohibited Conduct

You agree not to:

• Use the Site for any unlawful purpose or in violation of these Terms.
• Use any robot, spider, scraper, or other automated means to access the Site without Atlas's prior written consent.
• Attempt to gain unauthorized access to any portion of the Site, accounts, systems, or networks.
• Interfere with, disrupt, or attempt to disable security-related features or the integrity of the Site.
• Reverse engineer, decompile, disassemble, or attempt to derive source code from any portion of the Site.
• Upload or transmit malware, spyware, or other harmful code.
• Provide false, misleading, or inaccurate information, or impersonate any person or entity.

4. Transactions; Direct Ownership and Self-Directed IRA Purchases

4.1 Direct Ownership Purchases

For direct ownership purchases, you transact directly with Atlas. Payment may be made via approved methods including bank wire and checks, subject to Atlas's verification and compliance procedures.

4.2 Self-Directed IRA Purchases Through Independent Custodians

For self-directed IRA purchases, the transaction must be executed through an independent, qualified custodian administering the retirement account. Atlas does not act as a custodian or trustee and does not accept direct retirement account contributions from individuals. For any IRA-related purchase, Atlas will only accept funds remitted by the qualified custodian.

4.3 Rollover / Re-deposit Scenarios

Atlas does not provide tax, legal, or rollover advice. You are solely responsible for confirming compliance with IRS rules and custodian requirements and should consult qualified professionals. For any IRA-related purchase, Atlas will only accept funds remitted by the qualified custodian.

5. Pricing; Confirmations; Market Risk; Errors

Precious metals prices fluctuate and may change rapidly. Quotes, pricing, and availability are subject to change without notice. An order may not be accepted until confirmed by Atlas. If a product is listed with an incorrect price, Atlas may refuse or cancel orders at its discretion where permitted by law.

6. Cancellations; Market Loss

If a confirmed transaction is cancelled or a party fails to perform, Atlas may assess market loss or other charges consistent with disclosed policies and applicable law. Atlas reserves the right to refuse, cancel, or limit transactions where permitted by law.

7. Shipping; Insurance; Delivery (U.S. Only)

Atlas ships within the United States only. Delivery timelines are estimates and not guaranteed. Delays may occur due to carrier issues, verification processes, supply constraints, or events beyond Atlas's reasonable control.

8. Returns; Exchanges

Return or exchange eligibility (if any) will be governed by the terms provided in your Confirmation and applicable policies. Shipping and handling charges may be non-refundable unless required by law.

9. Disclaimer of Warranties

THE SITE AND ALL CONTENT ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. TO THE MAXIMUM EXTENT PERMITTED BY LAW, ATLAS DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. ATLAS DOES NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ATLAS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE OR ANY TRANSACTION, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ATLAS'S TOTAL AGGREGATE LIABILITY FOR ANY CLAIM SHALL NOT EXCEED (A) THE AMOUNT PAID BY YOU TO ATLAS FOR THE SPECIFIC TRANSACTION GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED DOLLARS ($100), WHICHEVER IS GREATER, UNLESS A DIFFERENT LIMIT IS REQUIRED BY LAW.

11. Indemnification

You agree to indemnify, defend, and hold harmless Atlas, its affiliates, and their respective owners, directors, officers, employees, and agents from and against any claims, demands, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to your access to or use of the Site, your violation of these Terms, or your violation of any law or third-party right.

12. Privacy Policy

Atlas collects, uses, stores, and discloses Personal Information in accordance with the Privacy Policy, which is incorporated into these Terms by reference.

13. Dispute Resolution; Binding Arbitration; Class Action Waiver; Jury Trial Waiver

To the extent permitted by law, any dispute, claim, or controversy arising out of or relating to these Terms, the Site, or any transaction shall be resolved by binding arbitration on an individual basis and not in a class, consolidated, or representative action. You and Atlas waive any right to a jury trial and to participate in a class action. Arbitration shall take place in Los Angeles County, California.

14. Governing Law

These Terms are governed by the laws of the State of California, without regard to conflict of law principles, except to the extent federal law applies.

15. Changes to the Site or Terms; Termination

Atlas may modify, suspend, or discontinue the Site or any feature at any time. Changes to Terms are effective upon posting. Continued use of the Site after changes are posted constitutes acceptance.

16. Communications; SMS/Mobile Messaging Terms

By providing your contact information, you consent to receive communications from Atlas regarding your inquiries, requests, and transactions. You may opt out of certain marketing communications as described in the message or by contacting us.

16.1 Mobile & SMS Terms

• Consent: You may receive recurring SMS/text messages from Atlas. Message frequency varies.
• Costs: Atlas does not charge for the SMS Service. Message and data rates may apply.
• Opt-Out: Reply STOP to opt out.
• Help: Reply HELP or contact legal@atlasgoldgroup.com or 1-800-219-0771.
• Carrier Liability: Carriers are not liable for delayed or undelivered messages.

17. Miscellaneous

• Severability: If any provision is found unenforceable, the remaining provisions will remain in effect.
• Entire Agreement: These Terms and any posted policies constitute the entire agreement regarding the Site.
• No Waiver: Failure to enforce a provision is not a waiver of the right to enforce it later.
• Assignment: You may not assign these Terms without Atlas's prior written consent.
